Instagram Auction Terms & Conditions
Program Overview: The thredUP and thredUP Circular Fashion Fund one-day event (the “Program’) is available at 5:00pm PST on Monday, March 29, 2021 and is open to residents of the fifty United States and District of Columbia, who are 18 years of age or older. Void where prohibited. The Program begins on Monday, March 29, 2021 at 5:00 pm PST and ends on Tuesday, March 30, 20201 at 5:00 pm PT (the “Program Period”). During the Program Period, thredUP will donate 100% of the sales price of every eligible item purchased through the Program, with a total maximum donation of $2,000.00.
How to Participate: To bid on an eligible tem, you must comment on @thredUP’s Instagram feed post with your bidding price (USD). You may only bid for one item per comment, however, you may bid for an item an unlimited number of times. A bid is a binding contract between you and thredUP to purchase the eligible item at the bid price you have entered. The winning bidder will be determined on the last, highest bid based on the timestamp (“Winning Bidder”). If you are the Winning Bidder, you will be contacted via direct message on Instagram by the thredUP team asking for the email address associated with your thredup.com account. Payment will be collected via Paypal. thredUP gift cards, Rewards, online credit, and any promotional offers may not be used towards purchase of the eligible item. Upon final payment, we will ship the eligible item to the requested shipping address. Eligible items will not be eligible for return or a refund. If the Winning Bidder does not respond or payment is not received in full within 24-hours, the runner-up Winning Bidder will be contacted in the same manner described above.
General Conditions: thredUP, thredUP Circular Fashion Fund, and their respective parent companies, affiliates, subsidiaries, distributors, and advertising and promotion agencies and (collectively, the “Released Parties”) are not responsible for lost, late, incomplete, inaccurate, or delayed purchases, availability or accessibility or miscommunications or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or other errors or problems of any kind. Should any portion of the offer be, in thredUP’s sole opinion, compromised by non-authorized human intervention or other causes which, in the sole opinion of thredUP, corrupt or impair the administration, security, fairness or submission of information, thredUP reserves the right at its sole discretion to terminate the Program if the human intervention was caused by thredUP Circular Fashion Fund or a thredUP Circular Fashion Fund employee, officer, or director. By participating, you agree to be bound by these Terms and Conditions and the decisions of thredUP which are final and binding.
Disputes: Except where prohibited, participant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Program shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the state of California; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Program, and in no event shall participant be entitled to receive attorneys’ fees or other legal costs or expenses unless expressly stated otherwise in the contract between thredUP and thredUP Circular Fashion Fund; and (c) Participant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, participant’s rights and obligations, or the rights and obligations of tredUP in connection with the Program, shall be governed by, and construed in accordance with, the laws of the state of California.
